Terms of Service.

1. About these terms

These Terms of Service (“Terms”) form a binding agreement between you and Mai Influence Limited, a company registered in Hong Kong (“Mai Influence”, “we”, “us”). They cover your use of maiinfluence.com and any related applications (the “Platform”). By creating an account or using the Platform you accept these Terms.

2. Who can use the Platform

You must be at least 18 years old to create an account. Talent who appear on the roster but are under 18 must be represented and onboarded by a parent or legal guardian; the guardian is the account holder for these purposes.

Brand accounts are issued to companies, agencies, or freelancers acting on behalf of a commissioning party. The individual creating the account warrants that they have authority to bind the company they represent.

3. Bookings

The Platform connects brands with creators. When a brand sends an offer and a creator accepts, a job commits both sides: deliverables, deadline, and payout are locked. Mai Influence acts as the merchant of record — invoices to brands and payouts to creators are issued by Mai Influence.

A 50% deposit is due at project start and the 50% balance is due at wrap. Both run through Stripe. Talent are paid the gross fee shown on their offer (no withholding deducted) at the end of the calendar month in which the brand's balance payment cleared.

4. Fees

Mai Influence charges brands a 15% platform commission, included in the project total. There is no separate fee for talent — your offered rate is what you receive.

5. Cancellation & refunds

Brands may cancel a project at any point before wrap. A cancellation refunds 75% of the deposit; Mai Influence retains the remaining 25% as a booking fee that covers talent commitment and platform operations. The balance is not charged if the project is cancelled before wrap.

Per-model pro-rating applies when a model can't attend day-of: 50% (standard), 25% (late notice + replacement arranged), or drop (no payment). The project total recalculates automatically.

6. Conduct

You agree to behave professionally on set and across all Platform communications. We do not tolerate harassment, discrimination, or unsafe working conditions. Reports of misconduct can be filed with hello@maiinfluence.com; we investigate and may suspend either side of an account while we do.

7. Image rights

Talent retain ownership of their portfolio images uploaded to the Platform. By uploading, you grant Mai Influence a non-exclusive licence to display those images to brands and within the agency portal for the purpose of matching and booking.

Final image rights from the shoot are governed by the individual project agreement between the brand and the talent, captured in the project brief and any side agreements. Mai Influence is not a party to those licences but we retain copies of the brief for the record.

8. Termination

Either side may close their account at any time. Outstanding obligations (open projects, unbatched payouts, in-flight refunds) survive account closure until settled.

9. Liability

Mai Influence is not liable for indirect, incidental, or consequential losses arising from a project. Our maximum aggregate liability for any project is capped at the commission we earned on that project (15% of the project total).

10. Governing law

These Terms are governed by the laws of the Hong Kong Special Administrative Region. Any disputes will be heard in the courts of Hong Kong.

11. Changes

We may update these Terms; the date at the top reflects the latest revision. Material changes will be notified by email and, where they require fresh consent, by a re-accept prompt on next sign-in.
